Terms and conditions for reservations: Hyvölä Houses
Hyvölä Houses applies these terms and conditions when renting holiday houses. These terms and conditions are binding to both parties after the customer has paid the advance fee as defined in the contractual terms and conditions, or the advance fee and the final sum at the same time, to Hyvölä Houses.
Terms and conditions for reservations and payments
The person making a reservation must be an adult (at least 18 years of age) at the time the reservation is made.
The reservation can be made online, in which case the reservation confirmation, advance fee invoice and final invoice are sent to the customer’s email immediately. The customer must at least pay the advance fee (30% of the price for renting the holiday house) within seven (7) days. The customer may also pay the entire reservation immediately.
The reservation can also be made by telephone. After the call, Hyvölä Houses will send the invoice to the customer by mail or email.
Any comments concerning the invoice must be made within seven (7) days of the invoice date. The invoice is paid as a SEPA payment (the IBAN account number and the bank’s BIC code) using the reference number on the invoice.
The reservation confirmation contains the name and contact details of the holiday house owner or the person responsible for the holiday house as well as the driving directions to the holiday house or the place where the keys are handed over.
The reservation is considered confirmed when the customer has paid the advance fee (30% of the price for renting the holiday house) by the due date or the advance fee and the final sum at the same time. The final sum must be paid at the latest six (6) weeks before the beginning of the reservation period.
In addition to the rent, a EUR 5 service fee will be charged.
If there are 63 days (9 weeks) or more until the beginning of the reservation period, the sum will be paid in two instalments. The advance fee is due at the latest within 14 days of the invoice date. The final sum is due six (6) weeks before the beginning of the reservation period.
If there are 50–62 days (7–9 weeks) until the beginning of the reservation period, the entire sum is paid at a time and the invoice must be paid six (6) weeks before the beginning of the reservation period.
If there are 28–49 days (4–7 weeks) until the beginning of the reservation period, the entire sum is paid at a time and the invoice must be paid at the latest within a week (7 days) of the invoice date.
If there are 27 days or less until the beginning of the reservation period, the entire sum is paid immediately on the same day.
If the customer does not make their payments on time, Hyvölä Houses may cancel the reservation without separate notification.
Reservations for the New Year
During the period from 26 December to 15 January, a house-specific final cleaning and bed linen fee is always added to the price of the reservation. The final sum is due ten (10) weeks before the beginning of the reservation period.
Cancelling and changing a reservation
Cancellations must always be made in writing (by mail to Hyvölä Houses, Kaijantie 133, FI-63700 Ähtäri, Finland
or by email to hyvolantalo@hyvolantalo.com).
A cancellation is considered made at the moment when Hyvölä Houses receives information about it. A cancellation made outside of office hours (office hours are 8:30 a.m.–4:30 p.m. on business days) is considered made on the next business day.
If the customer cancels their reservation, the advance fee and the service fee will not be refunded. If the reservation is cancelled later than 28 days before the beginning of the reservation period or during the reservation period, no payments made by the customer will be refunded.
Notwithstanding the above, the customer has the right to be refunded the amount they have paid to Hyvölä Houses, apart from the advance fee and the service fee, if the customer or a person living in the customer’s household falls seriously ill, is injured in an accident or dies. Hyvölä Houses must be informed of the cancellation immediately and Hyvölä Houses must be provided with reliable proof, such as a doctor’s certificate.
If the cancellation takes place later than 48 hours before the beginning of the reservation period or during the reservation, no payments made by the customer will be refunded.
If the customer changes their reservation (the holiday house, reservation period, additional services or number of persons), Hyvölä Houses has the right to charge EUR 20 as change expenses. The change must be made at the latest six (6) weeks before the beginning of the reservation period. Any changes made later than this are considered as the cancellation of the original reservation and the making of a new reservation.
Right of Hyvölä Houses to cancel a reservation
In case of force majeure, Hyvölä Houses may cancel a reservation. In this case, the customer has the right to be refunded the entire sum they have paid to Hyvölä Houses. If the reservation needs to be interrupted due to the customer’s behaviour, no payments are refunded.
If the customer does not make their payments on time, Hyvölä Houses may cancel the reservation without separate notification.
Service information in the description of the holiday house
The description of the holiday house includes information about services in the surrounding area (e.g. railway stations, bus stops, restaurants, shops, ski slopes, etc.). Hyvölä Houses is not responsible for information regarding general services that are not part of the holiday house or for the availability of such services during the reservation.
Staying at the holiday house The holiday house is at the customer’s disposal from 4:00 p.m. on the arrival date to 12:00 noon on the departure date. In some weekend reservations, the holiday house can be used until 10:00 p.m. on Sunday. The holiday house and key handover time is stated in the reservation confirmation.
The owner or the person responsible for the holiday house has the right to charge the customer a EUR 150 deposit on the customer’s arrival at the holiday house to serve as a security for the customer’s fulfilment of their obligations and for any potential damage. The holiday house owner or the person responsible for the holiday house returns the deposit to the customer on the departure date. The deposit or part thereof may be used to cover the damage and cleaning costs.
The holiday house and its keys are handed over to the customer at the estimated arrival time that the customer has given in advance by telephone or in writing to the owner or the person responsible for the holiday house. If the customer cannot come at the time they have given or if the customer has not given any arrival time, Hyvölä Houses cannot guarantee that the handover of keys can be arranged.
The rent includes the right to use the reserved holiday house during the reservation period. Normal energy costs, furniture, cooking dishes, tableware, mattresses, duvets and pillows are included in the price.
Firewood is included in the rent, unless otherwise indicated in the description of the holiday house. Dishwashing liquids, basic spices, toilet paper and paper towel are not included in the price.
The right to use the rowing boat is included in the price of lakeside holiday houses in summer.
Bed linen and towels are not included in the rent, unless otherwise indicated in the description of the holiday house. The customer must use bed linen. Bed linen and towels can be ordered in connection with the reservation.
The customer is responsible for cleaning the holiday house during and at the end of the reservation period, unless otherwise indicated in the description of the holiday house. Final cleaning can be ordered in connection with the reservation.
The holiday house may be used, at a maximum, by the number of persons that is indicated as the number of beds in the description of the holiday house or that has been agreed on when the reservation was made. Parties and other events in which this number of persons is temporarily exceeded must be agreed on in advance with the owner or the person responsible for the holiday house. The use of a tent, camper trailer or rented equipment (such as an outdoor hot tub) on the plot of the holiday house without a permission from the owner or the person responsible for the holiday house is prohibited. If the customer wants to bring their pets to the holiday house, this must be stated when making the reservation. Pets may only be brought to holiday houses where pets are allowed. In some holiday houses, an extra fee is charged for pets. Smoking is prohibited in all indoor areas of the holiday houses.
The customer’s obligations and the handover of the holiday house on the departure date
The customer checks out from the holiday house and hands over its keys on the departure date at 12:00 noon, unless otherwise indicated in the reservation confirmation. If the customer leaves at a different time, the handover of the keys and the return of the deposit must be agreed on well in advance with the owner or the person responsible for the holiday house.
If the customer leaves at an exceptional hour (e.g. during the night) or if the customer does not announce their departure, the owner or the person responsible for the holiday house has the right to return the deposit afterwards. The customer is responsible for any damage they cause to the holiday house. The holiday house owner or the person responsible for the holiday house must be informed of damage immediately. The customer is liable to compensate for any damage caused by them directly to the holiday house owner or the person responsible for the holiday house.
Smoking is prohibited in all indoor areas of the holiday houses. Upon departure, the holiday house must be left clean and tidy. The customer is responsible for paying costs caused by the cleaning of the holiday house if someone has smoked in the indoor areas of the holiday house or if cleaning has not been carried out or if it has been carried out inadequately and the holiday house owner or the person responsible for the holiday house must take care of the cleaning before the arrival of the next customer.
The final cleaning that the customer orders or that is included in the rent of the holiday house does not include dish washing and waste disposal. In addition, the customer must take empty bottles and cans away and place the furniture to its original position.
Force majeure
Hyvölä Houses is not responsible for the damage or loss caused to the customer by an unforeseeable force majeure event or similar reasons (e.g. power outages or natural phenomena, such as algae, or animals, such as mice and insects), which are not caused by Hyvölä Houses and the consequences of which Hyvölä Houses cannot reasonably prevent. Neither is Hyvölä Houses responsible for any damage caused by or the consequences of normal natural phenomenon.
Comments and complaints
All comments and complaints concerning the holiday house must be reported immediately when they emerge during the reservation period and addressed directly to the holiday house owner.
If the customer does not report the observed deficiencies to the owner immediately during the rental period, the holiday house is deemed to be in the agreed condition. Deficiencies reported only after the rental period cannot be ascertained together and Hyvölä Houses is not liable for compensation. If the customer interrupts their reservation and leaves the holiday house before the end of the rental period, no compensation is paid for the rental period left unused and the customer is not entitled to a rent refund.
Right of Hyvölä Houses to change prices After the contract has been concluded, Hyvölä Houses has the right to increase the agreed price and, similarly, the obligation to decrease the agreed price if taxes or public levies that influence the price of the holiday house service change.
Incorrect price details Incorrect price details are not binding to Hyvölä Houses if the price is so clearly incorrect that the customer should understand its incorrectness. This is the case if, for instance, the difference between the stated price and the actual price is remarkable or the incorrect price can be considered exceptionally low when compared to the general price level.
Applicable law and dispute resolution
The contractual parties seek to resolve any disputes arising from the contract through mutual negotiations. If no consensus is reached in the negotiations, disputes are resolved in the South Ostrobothnia District Court. The contract is subject to Finnish law.
